Terms of sale and provision of electronic services

Version: 2026-09-04-01Version date: September 4, 2026

Effective from 4 September 2026.

LayersFactory sells physical goods manufactured to an individual order by 3D printing from a ready file supplied by the Customer. File analysis and production preparation are ancillary activities. We do not sell, distribute or license 3D models.

1. Seller, Service Provider and contact

LayersFactory is operated by DCRA sp. z o.o., with its registered office at ul. Mełgiewska 74/7, 20-234 Lublin, Poland, entered in the entrepreneurs register of the Polish National Court Register maintained by the District Court Lublin-Wschód in Lublin with its seat in Świdnik, 6th Commercial Division of the National Court Register, under KRS 0000718408, tax number NIP 9462678787, REGON 369479181 and share capital of PLN 5,000. DCRA sp. z o.o. is the “Seller” of physical goods and the “Service Provider” of electronic services; these Terms also refer to it as “LayersFactory”.

Contact for orders, complaints, accounts, copyright notices and other rights concerning files or objects: [email protected], telephone +48 574 439 799. Pre-order quotation enquiries may be sent to [email protected].

2. Contract scope and definitions

  • A Customer is an individual, legal person or organisational entity that enters or intends to enter into a contract for the sale of goods with the Seller.
  • A User is an individual who uses the service, including its public pages, quote form or account. A User may be the Customer or may act for a Customer if authorised to do so.
  • The Customer supplies a ready 3D file and orders a specified number of physical goods made to their specifications. The paid contract covers the sale of those goods; file analysis, production preparation and delivery arrangements are ancillary activities.
  • LayersFactory performs technical analysis, selects or lets the Customer select production options, prints the object and arranges delivery.
  • LayersFactory is not a store, library or sourcing intermediary for 3D models. It does not sell rights to models or certify where they came from.
  • The Customer is responsible for sourcing the file and obtaining the necessary licence or permission.
  • A Consumer is an individual entering into a contract that is not directly related to their business or professional activity.
  • A sole trader protected as a consumer is an individual entering into a contract directly related to their business where the contract is not professional in character for that individual. Consumer protections apply to that person to the extent required by mandatory law, including rules on unfair terms, withdrawal and conformity of goods.

3. Rights to the file and Customer responsibility

By ordering, the Customer represents that they created the submitted model or hold a valid licence, consent or other permission to upload it, have it technically processed and manufacture the ordered number of physical copies.

The Customer also represents that the file, appearance of the object and intended ordered use do not infringe copyright, design rights, trade marks, patents, personality rights or other third-party rights.

For a Consumer or a sole trader protected as a consumer, these representations allow LayersFactory to assess whether the order may be accepted or fulfilled. LayersFactory may use the measures in section 5, but those persons do not assume LayersFactory's liability or third-party claims beyond the extent permitted by mandatory law.

A Customer who is neither a Consumer nor a sole trader protected as a consumer is liable for a culpable infringement of third-party rights resulting from the submitted file or stated use. To the extent permitted by law, that Customer will reimburse LayersFactory for reasonable, documented costs directly resulting from the infringement, provided that LayersFactory gives prompt notice of the claim and allows the Customer to participate in the defence.

4. Limited technical permission

No rights to the model are transferred to LayersFactory. For the time needed to fulfil the order, the Customer grants only a non-exclusive, non-transferable permission to store the file, make working copies, analyse, scale, technically repair, convert and send data to production equipment.

The permission covers only the number of copies stated in the order, complaint handling, legal and accounting duties, and the protection of claims. LayersFactory may not publish, sell or use the model for its own production or marketing without separate consent.

5. Prohibited orders and refusal

  • We do not accept clearly unlawful orders, orders infringing third-party rights, weapons or prohibited objects, or objects posing an unacceptable risk.
  • Where there are reasonable doubts, we may suspend the order, request evidence of a licence or consent, refuse production or remove the file.
  • A refusal is not a legal determination of ownership. It is a precaution intended to limit harm.
  • If LayersFactory refuses fulfilment before production starts, it refunds the full amount collected within 14 days after notifying the Customer, using the original payment method unless the Customer expressly agrees to another method that causes no additional cost.

6. Reporting an infringement

A person who believes a specific file or order infringes their rights may send a notice to [email protected].

  • The notice should identify the protected work or right, the notifier's contact details, the relevant file or order number if known, supporting reasons and evidence of authority.
  • After receiving a credible notice, we may promptly suspend printing, preserve necessary evidence, ask the parties for information and remove the file in accordance with applicable law.
  • We do not disclose Customer data to the notifier without a legal basis or a binding request from a competent authority.

7. Contract, price and payment

The information shown before confirmation summarises the individual order. The contract is concluded after the final price, delivery cost and these Terms are accepted and payment is confirmed.

Immediately before a Consumer places a paid order, the required information about the goods, price, duration and termination is displayed. The button or equivalent function that finalises the order is labelled “Order with obligation to pay” or with an equally unambiguous phrase.

Each amount is identified as net or gross. The complete gross amount, including applicable VAT and delivery, is displayed before payment is confirmed.

Changing the material, colour, scale, quantity, printer, quality or another option may recalculate the price. After a change, only the current price shown in the final summary applies; an earlier quote is no longer current.

If the file cannot be printed as selected or needs a material change, we contact the Customer before production. We do not make a material visual change without approval.

8. Nature and use of a 3D print

3D prints are made in layers. Minor layer and support marks, seam placement and other process traces are inherent features of the selected technology where they remain within the parameters presented before ordering.

A colour shown on a screen, visualisation or photograph is illustrative. The actual shade and its appearance may differ because of display settings, lighting, surface texture and the material batch. A colour name indicates an approximate colour, not a match to a specific standard such as RAL or Pantone, unless such a match is expressly agreed before the contract is concluded.

The actual dimensions of a print may differ from the digital model because of material shrinkage, thermal expansion, print orientation, layer height, geometry and post-processing. Differences within the tolerance stated for the selected technology, material or individual quotation are an inherent feature of the process.

If a particular dimension, fit or exact colour is critical, the Customer should state the requirement before placing the order so that LayersFactory can confirm the achievable tolerance or match to a colour standard. These provisions on inherent process features do not limit the statutory rights of a Consumer or sole trader protected as a consumer where an agreed tolerance is exceeded or the goods otherwise fail to conform to the contract.

The Customer must assess whether the design is suitable for its intended use. Without a separate written agreement, prints are not certified medical devices, protective equipment, food-contact products or safety-critical parts.

9. Delivery, non-conformity and complaints

The delivery time and cost are shown before ordering. Unless another date is agreed, the goods will be delivered no later than 30 days after the contract is concluded. The Customer should inspect the parcel and report damage or non-conformity to [email protected], including the order number and, where possible, photographs. A Consumer or sole trader protected as a consumer does not lose complaint rights merely because photographs are unavailable.

The Seller is liable to a Consumer and a sole trader protected as a consumer for a lack of conformity that existed when the goods were delivered and became apparent within 2 years. A lack of conformity found within 2 years is presumed to have existed on delivery unless that is incompatible with the nature of the goods or the non-conformity.

A Consumer or sole trader protected as a consumer may request repair or replacement. The Seller may replace instead of repairing, or repair instead of replacing, if the selected remedy is impossible or would involve excessive cost; it may refuse to bring the goods into conformity only where both repair and replacement are impossible or would involve excessive cost. Repair or replacement is completed within a reasonable time, without significant inconvenience and at the Seller's cost.

A price reduction or withdrawal may be requested where the law permits, including where the Seller refused or failed to bring the goods into conformity properly or within a reasonable time, the non-conformity persists, it is sufficiently serious to justify an immediate remedy, or the Seller's statement or circumstances show that conformity will not be restored. Withdrawal is unavailable where the lack of conformity is minor.

We respond to a complaint by a Consumer or sole trader protected as a consumer within 14 days after receipt unless mandatory law provides another period. We communicate the outcome and next steps on a durable medium. These Terms do not limit statutory remedies.

We do not provide a separate commercial guarantee or after-sales services beyond complaint handling and the remedies described in this section. This does not limit the Seller's statutory liability for conformity of the goods.

10. Withdrawal and order cancellation

A print made from the Customer's file in a selected material, colour, scale and quantity will normally be a non-prefabricated item made to the specifications of a Consumer or sole trader protected as a consumer. In the cases covered by Article 38(1)(3), read with Article 7aa, of the Polish Consumer Rights Act, the statutory 14-day withdrawal right is unavailable. The applicable exception is displayed directly before the order is placed.

If a contract concerns non-customised goods and no other statutory exception applies, a Consumer or sole trader protected as a consumer may withdraw without giving a reason within 14 days after taking possession. It is sufficient to send an unambiguous statement to [email protected] or our registered office before the deadline; the form in section 17 may be used.

Following withdrawal, we refund payments received, including the cost of the least expensive ordinary delivery method offered for the order, no later than 14 days after receiving the statement and by the same payment method unless another method is agreed without extra cost. We may withhold the refund until we receive the goods or evidence that they were sent back. The goods must be returned within 14 days after withdrawal. The withdrawing party bears the direct return cost if properly informed about it.

If production of custom goods has not started, LayersFactory may voluntarily agree to cancellation. Before confirming it, we state the documented costs actually incurred for material and reserved or used machine time and the proposed refund. If the Customer does not accept those terms, the order continues unchanged. If LayersFactory confirms cancellation without first agreeing a deduction, it refunds the full amount paid.

11. Files and confidentiality

Customer files are not a public library. Access is limited to people and providers necessary for production, system operation, delivery or compliance with a legal duty.

Files, previews and working copies uploaded in the workspace and not attached to an accepted order are removed by the deletion date shown with the model and generally no later than 7 days after upload. 3D models and reference files attached to the public quote form or an email sent to [email protected] are removed no later than 7 days after the message is received unless the enquiry leads to an accepted order. A file attached to an accepted order may be kept longer only as needed for production, delivery, complaints, a legal duty or legal claims, as described in the Privacy Policy.

12. Final provisions

Polish law applies while preserving any mandatory consumer protection granted by the law of the consumer's habitual residence. Changes to these Terms do not affect an order already concluded unless required by law or accepted by the Customer.

If a provision is ineffective, the remaining provisions continue to apply. The applicable legal rule and the nearest lawful interpretation replace the ineffective provision.

We do not subscribe to a code of good practice within the meaning of the Polish Act on Counteracting Unfair Market Practices.

These Terms are available in Polish and English. If the versions differ, the Polish version prevails, subject to mandatory protection granted to a Consumer by the law of their habitual residence.

13. Electronic services

  • Without an account, a user may view public LayersFactory information, these Terms and the Privacy Policy.
  • Without an account, a user may make a one-off submission through the public quote form with up to 5 attachments in STL, OBJ, 3MF, STEP, STP, PNG, JPG, JPEG, WEBP or PDF format. One attachment may be up to 10 MB and all attachments together up to 20 MB. This free electronic service starts when the form is submitted and ends when the message is delivered to LayersFactory; further communication takes place by email.
  • After registering, a user may operate an account, upload private 3D files, use automated technical analysis and quotation, place orders, track their status and — after the order is marked as delivered in the system — add one rating and optional comment linked to that order.
  • Creating and operating an account is free. A charge arises only for a separate print order after the price and delivery cost have been shown.

14. Technical requirements and account rules

  • The service requires an internet-connected device, a current JavaScript-capable browser, essential session cookies and an active email address.
  • The service accepts the formats and sizes shown by the upload field; for files uploaded through the signed-in panel, the current single-file limit is 50 MB. A file must be free of malicious code and suitable for technical analysis.
  • Users must protect their credentials, prevent unauthorised account access, and must not bypass security, overload the service, access another person's data or use the service unlawfully.
  • Supplying unlawful content is prohibited, including files that infringe third-party rights or contain malicious software.
  • An account and an order in one's own name may be created only by a person aged 18 or over who has full legal capacity. A person acting for another person or entity must be authorised to do so.

15. Account contract, termination and complaints

An account contract is concluded for an indefinite period when the user provides the required data, actively accepts these Terms, selects “Create account” and the service confirms account creation. Before registration, a direct link makes the Terms available for viewing, saving and printing.

A user may terminate the account contract at any time and without charge by sending a request to [email protected]. Closing an account does not automatically cancel an accepted order or earlier obligations and claims. Data is then processed only as described in the Privacy Policy.

We may suspend an account while investigating a security threat or material breach. We terminate for breach only after notice and a reasonable cure period unless immediate action is required by law, security or deliberate serious abuse.

A complaint about the account, analysis, quotation or another electronic service may be sent to [email protected] with the account email, problem description and requested resolution. We respond without undue delay and no later than mandatory law requires.

16. Out-of-court consumer dispute resolution

After completing the complaint process, a consumer may use an out-of-court complaint and redress procedure, including mediation by the competent Provincial Inspectorate of Trade Inspection or a permanent consumer arbitration court. Municipal and district consumer ombudsmen also provide free assistance. The Polish Office of Competition and Consumer Protection publishes information about available bodies and procedures.

Out-of-court dispute resolution is voluntary unless mandatory law provides otherwise. This does not restrict a consumer's right to bring a claim before the competent court.

17. Template withdrawal form

This form applies only to contracts for which a statutory withdrawal right exists. Send it to: DCRA sp. z o.o., ul. Mełgiewska 74/7, 20-234 Lublin, Poland, [email protected], telephone +48 574 439 799.

I/We hereby give notice that I/we withdraw from the contract for the sale of the following goods: … Date of contract / receipt of goods: … Name of the Consumer or sole trader protected as a consumer: … Address: … Order number (optional): … Signature (paper form only): … Date: …

18. Portfolio and reviews

The public Works gallery presents only real work completed by us. We publish visualisations and illustrative graphics on technology pages and identify them as illustrations, not completed orders. Project descriptions are not customer reviews or ratings.

We publish only reviews linked to an order placed through the user's account and marked as delivered in the system. Every published review is therefore verified by purchase and delivery; publication also requires the author's separate, freely given consent.
